Bronson Home Inspection Services LLC

Welcome to Bronson Home Inspection Services LLC (“Company,” “we,” “our,” or “us”). By scheduling, purchasing, or using any of our home inspection services, you (“Client,” “you,” or “your”) agree to these Terms and Conditions. Please read them carefully.
1. Scope of Services
1.1. Visual Inspection Only: Our inspections are limited to a non-invasive, visual examination of the accessible systems and components of the property at the time of the inspection.
1.2. No Guarantee of Future Performance: We do not guarantee the future condition, performance, or lifespan of any inspected system or component.
1.3. Exclusions: We do not inspect areas that are inaccessible, concealed, or unsafe, including but not limited to underground utilities, hidden wiring, interior of walls, and environmental hazards (e.g., mold, radon, asbestos, lead).
1.4. SOP: Our inspection service is based on the Standards of Practice by InterNACHI. Before we begin an inspection, the Client will receive a copy of these standards. The Client should read and understand them fully before signing the inspection agreement.
2. Client Responsibilities
2.1. The Client is responsible for providing full access to the property and ensuring that utilities are operational at the time of inspection. Utilities that are not functional or where access is not permissible due to Clients personal belongings, materials, items, or other objects that obstruct the use of utilities will not be inspected.
2.2. The Client acknowledges that failure to provide such access may limit the scope of the inspection.
2.3. The Client acknowledges that all pre-inspection agreements, notices, and documents requested must be signed by the Client prior to any inspection being performed.
2.4. The Client must have all children under the age of 18 removed from the inspection site for their protection during the inspection period. All pets of any kind should be removed from the property. We are not responsible for any pet issues on the property before, during or after the inspection process.
3. Payment Terms
3.1. All fees are due in full prior to or at the time of inspection, unless otherwise agreed in writing. All fees are payable by credit card only. We accept Visa, MasterCard, Amex, and Discover only.
3.2. Fees are non-refundable once the inspection has commenced.
3.3. Cancelation of payment after an inspection service will result in additional charges and fees and will be recovered to the fullest extent by Florida law.
4. Reports
4.1. Inspection reports are provided solely for the Client’s use and may not be relied upon by third parties without our written consent.
4.2. Reports represent the condition of the property at the time of the inspection only.
4.3. All reports will contain photos and / or the use of video either by drone or digital camera.
5. Limitation of Liability & Disclaimer of Warranties
5.1. No Liability for Hidden or Future Issues: The Client acknowledges that the inspection is not technically exhaustive and may not reveal all defects. Bronson Home Inspection Services LLC shall not be held liable for any defects, deficiencies, or issues discovered after the inspection, whether concealed, latent, or future-occurring.
5.2. Maximum Liability: To the fullest extent permitted by Florida law, our liability for any claims arising from the inspection is limited to the amount of the fee paid for the inspection.
5.3. No Warranties: We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or the condition of the property. If your property qualifies for the InterNACHI home buy back program you will receive information pertaining to this program separately. Terms and conditions apply that are not part of this listing of terms and conditions as this is a separated program and you may not qualify.
6. Indemnification
The Client agrees to indemnify, defend, and hold harmless Bronson Home Inspection Services LLC, its owners, employees, inspectors, and agents from any and all claims, damages, or expenses (including attorney’s fees, adjudication fees, and arbitration fees) arising out of or related to the inspection, except for those resulting from our gross negligence or willful misconduct under Florida law.
7. Arbitration & Waiver of Class Action
7.1. Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the inspection, or our services shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
7.2. Location: Arbitration shall take place in Hillsborough County, Florida unless the parties mutually agree otherwise.
7.3. Waiver of Class Actions: You agree to resolve disputes with us only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
8. Digital Acceptance & Electronic Signatures
By booking an inspection online, submitting payment electronically, or checking any "I Agree" box on our website or service platform, you acknowledge that you have read, understood, and agree to these Terms and Conditions. Such electronic actions shall have the same legal effect as a handwritten signature.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida.
10. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties and supersede all prior understandings, whether written or oral.
By scheduling or paying for an inspection with Bronson Home Inspection Services LLC, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the arbitration and digital acceptance provisions.
